Abstract
Although any textbook of classical international law considers the POLISARIO Front an example of a national liberation movement, throughout the proceedings before the Court of Justice of the European Union (CJEU), both the EU institutions and the parties that have intervened to defend the legality of the free trade and fisheries agreements between the EU and Morocco – despite their application to Western Sahara – have questioned both whether the Polisario Front possesses such status and whether it is the sole and legitimate representative of the Sahrawi people. This study analyses the arguments that confirm both its international subjectivity and its status as a national liberation movement.
