Resumen

Los indultos son uno de los instrumentos de la política penitenciaria más controvertidos desde el punto de vista democrático. Sirviéndome de la teoría del equilibrio interrumpido de Baumgartner y Jones, elaboro un modelo estadístico que permite analizar la racionalidad de dicha concesión de indultos para 1982-2014. Las principales conclusiones a las que llego son que los indultos vienen determinaos por la opinión pública, la propia dinámica de la institución y, en menor medida, por la severidad de la cuestión penitenciaria. El signo político del gobierno no es determinante en la concesión de indultos.

Abstract

Pardons are one of the most controversial instruments of the prison policy from a democratic point of view. Using the punctuated equilibrium theory by Baumgartner and Jones, I construct a statistical model that allows me to analyze the rationality of the clemency power from 1982 to 2014. The main conclusions are: pardons are determined by public opinion, the dynamic of the institution itself and, to a lesser extent, by the severity of the prison system. The political affiliation of the Executive does not show a statistical significance.
