Resumen

En este artículo se critica la actitud metodológica que hace caso omiso del texto del Código civil. Se recuerda la actitud del humanista Ulrico Zasio como modelo de respeto a los textos legales y de confianza en la razón, así como su rebeldía contra el argumento ab auctoritate. A través de varios ejemplos significativos, se muestra la actitud metodológica de la doctrina dominante de desprecio al texto del Código civil. En esos ejemplos se observa la tendencia a imponer la autoridad de la doctrina a la autoridad del texto legal. Esta actitud puede resumirse en las siguiente frase: “Diga lo que quiera el Código civil, aquí hay en rigor un derecho de a crecer”. Se observa un claro cambio de actitud ante el texto del Código civil a partir de los años cuarenta del pasado siglo. Por el contrario, el autor reclama mayor deferencia hacia los enunciados legales y una más atenta lectura del Código civil. La doctrina debe someterse a la autoridad del texto legal y no debe pretender imponerse a él.

Abstract:

This article criticizes the methodological attitude that ignores the text of the Civil Code. It recalls the attitude of the humanist Ulrico Zasio as a model of respect of legal texts and confidence in reason, and his rebellion against the argument ab auctoritate. Through several examples, it shows the methodological attitude of the dominant doctrine of contempt to the text of the Civil Code. In these examples, there is a tendency to impose the authority of the doctrine to the authority of the legal text. This attitude can be summarized in the following sentence: “No matter what the Civil Code says, but here is a right of accretion”. This attitude toward the text of the Civil Code arises mainly from the forties of last century. On the contrary, the author calls for greater deference to law statements and a more careful reading of the Civil Code .The doctrine is subject to the authority of the legal text and should not seek to impose on it.
