Resumen

Es la hora, nos dicen, de la Justicia, y como ciudadanos y como juristas, no nos queda más que considerar empeñada la palabra de nuestros gobernantes y representantes, expresada en el templo de la soberanía popular. La Nueva Oficina Judicial, conforme a lo previsto en la LO 19/2003,y al Proyecto de Ley de Reforma de la Legislación Procesal para la Implantación de la Nueva Oficina Judicial, de 12 de diciembre de 2008, se configura como la institución prevista para sustituir el actual modelo de Secretaría Judicial, que se caracteriza, al decir de la mayoría de los estudiosos y de los operadores jurídicos afectados: por no favorecer la organización racional del trabajo que en su seno se desarrolla, ni propiciar una articulación eficaz de los profesionales y de los recursos materiales de que dispone. Es el momento de que la Jurisdicción Voluntaria deje de ser una simple área de experimentación para el legislador. Tenemos ahora la oportunidad de modernizar la Justicia en esta materia y de hacerlo con la intención de asegurar su permanencia en el futuro, desde una posición de consenso y progreso y en una esfera decididamente técnica del Orden Jurisdiccional.

Abstract:

It is time, they tell us, for justice; and we, as citizens and as jurists, can do nothing other than trust the word of our governors and representatives, which has been expressed in the temple of the popular sovereignty. The new Judicial Office is in accordance with that originally laid out in LO 19/2003, as well as the Reform Bill for Procedural Legislation for the Implementation of the New Judicial Office of the 12th December 2008, This office has been set up to replace the current judicial secretary model, which, according to the majority of the specialists and the affected juridical personnel, does not favour the sensible organization of the work done there, nor does it bring about an efficient use of the professionals and the material resources that it has at its disposal. It is time that Voluntary Jurisdiction ceases to be a mere area of experimentation for the legislator. We now have the opportunity to modernise Justice in this subject and to do so with the will of assuring its permanence in the future, from a position of consensus and progress and in a decidedly technical sphere of the Jurisdictional Order.
