Abstract

The legal status of irregular migrants makes them vulnerable to different legal systems and laws, especially given that the European Union and many of its Member States associate their presence with insecurity and threat. In this context, the question of the guarantee by States of human rights for migrants in irregular residence situations arises, as well as the need to establish a constitutionality of human rights.
